INFLUENCER POLICY

  1. Introduction

    Thank you for choosing Financial Basket Capital Pvt. Ltd. (“ETF Junction” “we,” “us,” “our”)! This Influencer Policy is an integral part of the Terms. This Influencer Policy is between us and you the Influencers (“user” “you” “your”) who we approve as Influencers (“hereinafter collectively referred to as the “Platform”).

  2. Onboarding

    By clicking “accept” or other synonymous terms when prompted, you agree that we reserve the right to accept you as an Influencer or reject your application. This essentially means that your application is subject to our review, and we may reject your application in our sole discretion. In addition, you also agree to adhere to all our Terms.

  3. Influencer Terms.

    3.1 As an Influencer, you may create a portfolio and decide to share your portfolio with other users on the Platform. You will get access to the following:

    3.1.1 Portfolio viewing fee: When your Portfolio is viewed by other users of the Platform, you will receive amounts as may be set by you and mentioned on the Platform and revised from time to time with or without notice to you in accordance with this Influencer Policy. Refer to the Privacy settings section of the platform.

    3.2 To be eligible for this Portfolio viewing fees, you (i) must be a citizen residing in the territory of India, (ii) must not be disqualified by us from using the Platform.

    3.3 While setting up your User profile, we will ask for your consent to Share your portfolio and portfolio updates with other users. When you agree to share your portfolio with other users of our community, they will be able to see the following items of your profile:

    3.3.1 ETFs you hold in your portfolio and the percentage holding for each

    3.3.2 your buy and/or sell transactions

    3.3.3 Gains or losses (in percentage) your portfolio incurred during the last 1month, 3 month, 6 month, 1 year, Year to date, 3 years, 5 years

    3.3.4 How your portfolio compares with other users’ portfolio

    3.3.5 No amounts (total portfolio value or transaction amounts) will ever be shown

    3.3.6 No personal information will be shared with any other users, only login name and your profile picture will be shared.

    3.4 You may set the amounts which are chargeable for viewing your portfolio. Set this amount carefully because this impacts the number of times your portfolio is viewed.

    3.4.1 You will be paid a fee each time someone views your ETF holdings/ portfolio

    3.4.2 Anyone who views your portfolio will automatically become a follower. Your followers are able to see any trades you make.

    3.4.3 ETF Junction will pay you not more than 50-75% of any amounts derived from the Portfolio Viewing Fees (“Influencer Share”). ETF Junction shall be entitled to the remainder of the amounts after subtraction of your Influencer Share.

    3.4.4 The Influencer Share paid to you is based on sole discretion of ETF Junction and is subject to change on sole discretion of ETF Junction.

    3.4.5 ETF Junction does not withhold any taxes hence it is your responsibility to duly report any such incomes for taxation purposes.”

    3.5 If you are rejected by us, it means that you do not meet our eligibility parameters. You may reapply to become an Influencer after a period of not less than thirty (30) days.

    3.6 Review process: Your application will be put into queue once you meet our eligibility requirements mentioned herein. Our reviewers will assess your application as a whole to check whether you meet our monetization policies. We will contact you with a decision once your application is reviewed (typically about 1 week). Note: Sometimes, you may need to wait more than a month. There may be numerous reasons for delay, including without limits, higher than usual application volumes, system issues, etc. We will strive to review applications as fast as possible, but delays may occur.

    3.7 Can application be expedited: No, we cannot speed up your application. All applications are put in a queue and will be processed in the order they are received. Applications may require multiple reviews, especially when multiple reviewers disagree on your application. In these cases, multiple reviews may be needed, which means it may take more time for a decision to be made.

    3.8 ETF Junction reserves the right to display Influencer rankings on the Platform for all users to view. You hereby grant ETF Junction permission to display your rankings on the Platform.

    3.9 ETF Junction reserves the right to display your Influencer profiles utilizing a predefined sequence using parameters in our sole discretion.

    3.10 Rankings and the sequence of display of Influencer profiles are calculated by ETF Junction using set parameters in our sole discretion. By agreeing to our Terms, you also agree to the ranking calculation methods and parameters used by us. You reserve the right to terminate your agreement with us in the event that you do not agree to our Terms.

  4. License to use content

    All content created, provided to us or otherwise derived by us from you (collectively, "Content"), Influencer hereby grants ETF Junction a royalty-free, nonexclusive, worldwide, license to display, reproduce, distribute, modify, prepare derivative works of, perform, and otherwise use and exploit all Content in connection with the promotion and marketing and/or monetization on other appropriate platforms including without limits, Youtube, as long as this agreement is in effect.

  5. Advertisement

    Subject to the license granted under this Influencer Policy, ETF Junction reserves the right to display, advertise, your Influencer profiles on the Platform during the subsistence of our contract with you . If you have any questions regarding this Influencer Policy, you may contact us using the contact information provided below in this document in Section 9.

    In the event that you do not want us to advertise/ display your Influencer Profile publicly on our Platform, you may terminate your contract with us OR you may decide to not agree to share your portfolio.

  6. Disclaimer.

    You will have the option to monetize your ETF portfolio which will hide the constituents of your Monetized Portfolio. When a user of the Platform views your Monetized Portfolio, they will solely have access to your Monetized Portfolio returns.

    Charts and performance numbers (including charts of Monetized Portfolios) might include back tested/simulated results (defined below) calculated via a standard methodology. Data used for calculation of historical returns and other information is provided by exchange approved third party data vendors and has neither been audited nor validated by ETF Junction.

  7. Miscellaneous

    7.1 In the event that we approve you as an Influencer, you hereby agree that you will adhere to our Terms.

    7.2 You will not utilize the Platform in any way which may be construed as a misuse of our services, or otherwise be illegal.

    7.3 You assume all risk and responsibility with respect to the service you provide to the Platform users as an Influencer, and the use of the Platform services. Please read our Terms and Conditions prior to registering with us as an Influencer as the same applies to Influencers as well

    7.4 You agree that ETF junction is solely an intermediary and is thus protected under safe harbor laws under the Information Technology Act, 2000, as well as other relevant provisions as may be notified by the relevant authorities from time to time.

    7.5 In the event of any disputes between you and us, the Governing Law and Dispute Resolution section of our Terms and Conditions shall apply.
